1. Agreement to Terms

By accessing, downloading, installing, or using the DEGEN CARTEL application, website, and related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease all use of the Service and uninstall any downloaded software.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DEGEN CARTEL ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after any modification constitutes acceptance of the updated Terms.

2. Nature of the Service — Information Only

DEGEN CARTEL provides AI-generated sports analysis, statistical data, confidence ratings, and informational content related to sporting events. The Service is strictly an information and analytics tool. We want to make the following absolutely clear:

• We do NOT operate as a sportsbook, bookmaker, or betting exchange.
• We do NOT accept, place, or facilitate any wagers, bets, or gambling transactions on your behalf or on behalf of any third party.
• We do NOT provide financial advice, investment advice, or gambling advice of any kind.
• We do NOT guarantee the accuracy, completeness, or reliability of any analysis, pick, confidence rating, or other content provided through the Service.
• We do NOT endorse, recommend, or promote any specific sportsbook, betting platform, or gambling activity.
• All "picks," "confidence ratings," and "analysis" are AI-generated informational outputs and should be treated as entertainment content only.

3. User Responsibility and Assumption of Risk

By using the Service, you expressly acknowledge and agree to the following:

• Sole Responsibility: Any decision you make based on information obtained through the Service is made entirely at your own risk and is your sole responsibility. DEGEN CARTEL bears absolutely no responsibility for any actions you take or decisions you make as a result of using the Service.
• No Reliance: You agree not to rely on the Service as the sole basis for any financial decision, wager, bet, or other action that could result in financial loss.
• Independent Judgment: You agree to exercise your own independent judgment and conduct your own research before making any decisions based on information from the Service.
• Financial Risk: If you choose to engage in sports betting or gambling using information from the Service, you acknowledge that gambling involves substantial risk of financial loss, and you accept full responsibility for any and all losses incurred.
• Legal Compliance: You are solely responsible for ensuring that your use of the Service and any related activities comply with all applicable federal, state, local, and international laws and regulations in your jurisdiction.

4. Eligibility and Age Requirement

The Service is intended exclusively for individuals who are at least 21 years of age. By using the Service, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms. If you are under 21 years of age, you are strictly prohibited from using the Service. We reserve the right to terminate access for any user found to be under the age of 21.

5. Subscription and Payment

Access to certain features of the Service requires a paid subscription at $4.99 per month, billed through Stripe. By subscribing, you agree to the following:

• Your subscription will automatically renew each month unless canceled before the renewal date.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• No refunds will be issued for partial billing periods or unused subscription time.
• We reserve the right to change subscription pricing with 30 days' notice to existing subscribers.
• Failed payments may result in suspension or termination of your access to the Service, including remote disabling of the mobile application.

6. License and Restrictions

Subject to your compliance with these Terms and payment of applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. Under this license, you may not:

• Modify, copy, distribute, or create derivative works based on the Service or its content.
• Reverse engineer, decompile, or disassemble any software components of the Service.
• Use the Service for any commercial purpose, including reselling or redistributing picks or analysis.
• Share your account credentials or allow unauthorized access to the Service.
• Use automated tools, bots, or scripts to access or interact with the Service.
• Circumvent or attempt to circumvent any access controls, security measures, or subscription requirements.

7. Remote App Management

You acknowledge and agree that we may remotely disable or restrict functionality of the DEGEN CARTEL mobile application under the following circumstances:

• Subscription cancellation or expiration.
• Failed payment or past-due invoices.
• Violation of these Terms of Service.
• Suspected fraudulent or unauthorized use.

Upon successful payment of past-due invoices, app functionality will be automatically restored. We are not responsible for any inconvenience caused by remote app management actions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEGEN CARTEL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities.
• Financial losses resulting from gambling, betting, or wagering activities.
• Losses resulting from reliance on any information provided through the Service.
• Damages arising from unauthorized access to or alteration of your data.
• Any other damages arising out of or in connection with your use of the Service.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Indemnification

You agree to indemnify, defend, and hold harmless DEGEN CARTEL, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any gambling, betting, or wagering activity you engage in; or (e) any claim by a third party related to your use of the Service.

11. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and AI-generated analysis, are the exclusive property of DEGEN CARTEL or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding. You agree to waive your right to a jury trial and to participate in a class action lawsuit.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the courts located within the United States for the resolution of any disputes not subject to arbitration.

16. Severability
